These Terms and Conditions apply to all individuals, entities, or organizations utilizing or intending to utilize the financial products and services offered by SLR. The scope encompasses, but is not restricted to:

  • Account holders
  • Registered users of SLR's online platforms or mobile applications
  • Any individual or entity engaging with SLR's services through authorized channels.

The terms detailed herein prevail over any prior agreements or understandings between SLR and its customers, except where explicitly stated and agreed upon in writing by both parties.

4.0 Explanation of Key Terms

4.1. Digital Lending

This means the practice of providing loans or credit facilities through online platforms or digital channels, often utilizing technology for loan application, approval, disbursement, and repayment.

4.2. Loan Applicant

This means an individual or entity applying for a loan from a digital lending platform.

4.3. Credit Score

This means a numerical representation of an individual's creditworthiness based on their credit history, financial behaviour, and repayment patterns.

4.21. Registered Phone Number

This means the specific phone number associated or linked with an individual's account or profile within a system or service.It is used for communication, verification, and authentication purposes.

4.22. SMS (Short Message Service)

A text messaging service available on mobile phones that allows users to send and receive short written messages. It's commonly used for communication, alerts, and notifications.

4.23. Loan

This means a financial arrangement where a lender provides funds to a borrower under specific terms and conditions, including repayment terms, interest rates, and schedules. The borrower is obligated to repay the borrowed amount according to the agreed-upon terms.

4.24. USSD (Unstructured Supplementary Service Data)

This is a technology used to send text-based messages between a mobile phone and an application server, typically to access services or perform transactions via a telecom network. It's commonly used for mobile banking, balance inquiries, or mobile payments.

5.0. Eligibility Criteria

5.1 Applicants must be at least 18 years old at the time of loan application.

5.5 Applicants must possess an active mobile number registered in their name, ensuring communication and access to digital services.

5.7 Applicants are required to thoroughly read and understand the terms and conditions of the loan, ensuring they agree to and can comply with the stipulated terms.

5.9 Applicants will be required to provide necessary documents for identity verification, income verification, and other relevant documentation as per Standard Life Rwanda Plc's requirements.

5.10 Applicants should be responsive to communications from Standard Life Rwanda Plc throughout the loan application and approval process.

5.11 Standard Life Rwanda Plc assesses the applicant's debt-to-income ratio to ensure that the new loan instalment is manageable based on the applicant's existing financial obligations.

5.12 For employed individuals, a stable employment history and confirmation of current employment will be required.

5.16 Having an active and verified bank account or Mobile money wallet will be a requirement for loan disbursement and repayment purposes.

5.17 Applicants might be subject to maximum loan limits based on their income, creditworthiness, and existing loan history, if any.

5.18. Individuals with a history of responsible repayment

Individuals with a history of responsible repayment with Standard Life Rwanda Plc or other financial institutions may receive favourable consideration.

5.19. Compliance with all regulations

Compliance with all regulations governing digital lending services, including interest rate caps and consumer protection laws.

5.20. Customer information

Customers would be prompted to provide necessary information, such as their name, email address, home address, personal phone. This information is used for account creation and verification purposes.

6.0. Registration and Account Creation.

To avail services provided by Standard Life Rwanda Plc, individuals or entities must meet the eligibility criteria specified in Section 5.0 of these Terms and Conditions.

6.2 Prospective customers must complete

Upon completion of the registration process, applicants will be required to submit the necessary documentation and information as per SLR's requirements for account creation.

SLR reserves the right to verify the submitted information and documentation to confirm the applicant's eligibility and compliance with the outlined criteria.

6.5 Upon successful verification, SLR will approve

Upon successful verification, SLR will approve the account creation and activate the customer's access to specified services, subject to the Terms and Conditions herein.

7.0. Account Responsibilities:

7.1. Customers are responsible for providing accurate

Customers are responsible for providing accurate and up-to-date information during the registration and account creation process. Any discrepancies or inaccuracies may lead to account suspension or termination.

7.2. Account holders are responsible for maintaining

Account holders are responsible for maintaining the confidentiality of their account credentials, including passwords, PINs, or any other authentication methods provided by SLR. Any unauthorized access or misuse of account details must be reported immediately to SLR through support@standardlife.org.rw.

7.3. Customers must adhere to all applicable laws, regulations

8.0 Compliance with Regulations and Laws

8.1 Regulatory Compliance:

Customers engaging with SLR agree to comply with all relevant laws, regulations, and guidelines set forth by the regulatory authorities in Rwanda governing financial institutions and consumer protection.

8.2. Customers are responsible for providing accurate and updated

Customers are responsible for providing accurate and updated information and documentation as required by SLR for regulatory compliance, including but not limited to Know Your Customer (KYC) requirements and Anti-Money Laundering (AML) regulations.

8.3. In the event of changes in regulatory requirements, SLR reserves

9.0 Modifications to Terms and Conditions

9.1. Amendments to Terms:

SLR retains the right to modify, amend, or update these Terms and Conditions at its discretion. Notice of modifications will be communicated through appropriate channels, including but not limited to emails, notifications within digital platforms, or official announcements.

By continuing to use SLR's services after the notification of modifications to the Terms and Conditions, customers implicitly agree to the updated terms. It is the customer's responsibility to regularly review the Terms and Conditions for any changes.

10.0 Termination of Services

10.1 SLR reserves the right to terminate or suspend services provided to customers at its discretion, including but not limited to instances of violation of these Terms and Conditions, non-compliance with regulations, fraudulent activities, or other reasonable causes.

11.0 Prohibited Business Activities

Standard Life Rwanda Plc would not finance or do business with any individual or entities involved in:

  • Any business engaged in illegal activities or prohibited by Rwandan law.
  • Businesses related to gambling, betting, or any form of speculative financial activities.
  • Financing businesses involved in the production, trade, or distribution of weapons, firearms, ammunition, or military equipment.
  • Activities that harm the environment, such as deforestation, illegal mining, or businesses involved in illegal wildlife trade.
  • Businesses engaged in exploitative practices, human trafficking, or forced labor.
  • Investing or financing in unregulated or illegal cryptocurrency trading activities.
  • Production or distribution of products harmful to public health or safety without appropriate certifications or regulatory compliance.
  • Any business model resembling pyramid schemes or Ponzi schemes that rely on unsustainable financial practices.
  • Financing for political campaigns or religious institutions unless explicitly aligned with socially responsible initiatives.
  • Businesses dealing with hazardous chemicals or substances without adequate safety measures or compliance with environmental regulations.
  • Businesses operating without proper licenses or regulatory approvals mandated by Rwandan authorities.
  • Businesses involved in deceptive marketing practices or misrepresentation of products or services.
  • Financing for pharmaceutical stores or supplement manufacturers without proper regulatory compliance.
  • Businesses involved in exploitative labor practices, child labor, or inadequate labor rights compliance.

We reserve the right to add new categories of transactions that are not allowed. If you try to make a transaction that violates these rules, we may take action such as:

  • Reverse the transaction.
  • Close or suspend your SLR Account.
  • Report the transaction to the relevant law enforcement agency.
  • Claim damages from you.
  • Charge you an administration fee in case we apply any of the above.

12.0 Liability

12.1 In case of an unauthorized payment or a payment that was incorrectly executed due to an error by us, we shall refund the payment amount including all fees deducted upon your request. However, we reserve the right to investigate the matter before the refund.

13.0 Loan Products/Agreement

Standard Life Rwanda Plc (SLR) extends a range of tailored financial solutions to address immediate needs and foster entrepreneurial growth within the community. Our loan portfolio includes two distinct products designed to cater to diverse requirements:

a. Emergency Loans:The Emergency Loan facility offers rapid financial assistance with an interest rate of 15% per month, providing timely support during unexpected financial challenges.

b. Salary Loan: Our Salary Loan offer a competitive monthly interest rate of 7% reducing balance on outstanding principal, aimed at empowering entrepreneurs and enterprises to fuel sustainable growth, invest in their ventures, and seize opportunities for expansion.

Both loan products align with our commitment to offering accessible and transparent financial services tailored to meet the evolving needs of our valued customers. These loans are subject to specific interest rates, repayment schedules, and terms/conditions. These Terms and Conditions set out the Lender's offer and the terms of this Agreement.

When you apply for a loan, you will need to provide certain personal information such as your date of birth and National Security Number. This information is used for verification purposes.

14. Definition of Terms of Agreement

In this agreement, the terms: "you," "your," "customer," and "borrower" refer to the person who has applied for this account and agreed to this agreement. The terms "we," "us," "our," and "lender" refer to Standard Life Rwanda (SLR), and after assignment, any person, company, or bank to whom the rights and/or obligations of the lender have been assigned.

14.1 "Account" means the borrower's account with the lender.

14.2 "Disbursement Date" refers to the date when the lender has actually advanced the loan to the borrower.

14.3 "Payment Due Date" refers to the date when the installment should be repaid.

14.4 "Credit Limit" refers to the maximum credit available to the borrower on opening the account with the lender.

14.5 "Loan" refers to the amount advanced to the borrower by the lender, which shall be no less than 10,000.00 (Ten thousand) RWF.

15.0 Loan Fees

15.1

The loan fee for the loan that you are required to pay in relation to any loan will be displayed on the app.

If you fail to make repayments as and when due, a penalty fees is charged on principle amount due i.e. for emergency loan is 0.5 % per day while Salary loan is 1% per day in addition to the current rate of interest on outstanding debt.

The loan fee may be increased or decreased from time to time by the lender. Any such changes will take effect on your account following a minimum of 30 days written notice.

16.0 Borrower's Obligations

16.1

The Borrower must pay the loan amount, including any convenience, default, or penalty fees, flat interest rate, and any other amounts due to the Lender charged to this Account. The Borrower promises to pay these amounts as agreed in this Agreement on or before the Payment Due Date.

16.2

The Lender reserves the right to assume that any loan application made in the name of the Borrower using this Account has been authorized by the Borrower. The Borrower will be held responsible for any unauthorized application made using this Account unless the Borrower notifies the Lender in writing of any imminent fraud by another person on the Borrower's account within 12 hours of such fraud.

16.3

To repay the loan that has been given to you or someone you have authorized to use this Account, you can do so through direct cash transfer to a bank account that has been listed by the Lender, an electronic debit from the card/account you provided on the due date or any other acceptable electronic channel.

16.4

The Lender has the right to accept early repayment before the Payment Due Date, provided that the Borrower has given adequate notice and repays the full loan amount along with the flat interest rate. If you choose to repay the loan via electronic debit card, the Lender may process the payment in the manner specified hereinafter:

16.4.1

When setting up a new debit card on your account, the Lender will charge a one-time processing fee. If your card is expired or about to expire, you'll need to obtain a renewed card from your bank or provide us with another personal debit card.

16.4.2

On the repayment due date, the Lender will deduct the payment from the card or mobile wallet you set up. We'll only make transactions on the card/wallet within the scheduled loan repayments. If you initiate a double repayment in error, we'll make our best effort to process a refund within a reasonable time.

16.4.3

You hereby indemnify us against any losses, liabilities or damages that may arise if you use a third party’s card on your Account without the consent of such third party.

16.4.4

If there are insufficient funds in your bank account to cover a payment, you authorize us to charge any other cards listed on your Account or profile, other than the primary card, on an ongoing basis until the debt is settled.

16.4.5

You understand and agree that we do not store your card details on our platform. All card details shall be processed via a secure payment gateway that is compliant with the Payment Card Industry Data Security Standard (PCI DSS).

16.5

You agree to provide The Lender with accurate and up-to-date personal, social media, phone, and financial records about you, which we may reasonably request and analyze from time to time.

16.6

The Borrower shall indemnify and hold harmless the Lender and its representatives (each, an “Indemnified Person”) from and against any and all suits, actions, proceedings, claims, damages, losses, liabilities, and expenses...

16.6.1

The Borrower is responsible for any credit that has been extended, suspended, or terminated under this Agreement, or any loan documents.

16.6.2

The Borrower will indemnify the Lender against any claims, damages, losses, liabilities, or expenses that arise from the transactions contemplated under this Agreement or any loan document, including legal costs and expenses. This indemnification covers any disputes between or among any parties to this Agreement or any loan document, and it is collectively referred to as “Indemnified Liabilities”.

16.6.3

However, the Borrower will not be liable for any indemnification to an Indemnified Person to the extent that any such suit, action, proceeding, claim, damage, loss, liability, or expense results solely from that Indemnified Person’s gross negligence or willful misconduct, as finally determined by a court of competent jurisdiction.

16.7

The Borrower also agrees that:

16.7.1

Not to give us false information or signatures, electronic or otherwise, at any time.

16.7.2

To pay a Late Fee or penalty fee as may be provided in these terms and conditions.

16.7.3

To ensure timely payments, choose to pay via direct debit or electronic funds transfer as noted in the application form.

16.7.4

To promptly notify us if you change your name, mailing address, e-mail address, or telephone number.

16.7.5

To honor any other promises that you make in this Agreement.

Not to accept this Account unless you are of legal age and can enter a valid contract.

Not to use SLR for any act of illegality or criminality, as SLR Microfinance Institution will not be criminally culpable for any illegality committed by you.

To give the Lender legal authority to deduct full repayment before the due date when it is established that the loan was obtained fraudulently.

To fill out the application form (as provided) with accurate information and details as required.

17.0. Lender’s Obligations

17.1

To make available the loan/credit facility to the Borrower of a figure not less than 10,000 RWF (Ten thousand RWF only)

To perform above upon confirmation of the Borrower’s identity and personal information

To demand repayment for the Borrower as and when due

17.4

To conduct investigations on the Borrower prior to opening an account for the Borrower

17.5

To use all reasonable and legitimate means to collect the amount extended to the Borrower, the default fee, the admin fees, and any other penalty fee imposed on the Borrower because of the loan.

Not to store or save the Borrower’s debit or credit card details given by the Borrower in the application form.

18.0. Credit Reference

18.1

The Lender or its authorized representatives will use dedicated credit agencies to consider applications for credit reports on borrowers.

The borrower gives permission to the lender to access their information provided by the credit agency.

18.3

The Borrower agrees that their personal details and loan decision may be registered with the Credit Agency, except for their card details.

19.0. Notices

19.1

The Borrower agrees that The Lender may communicate with them by sending notices, messages, alerts, and statements in relation to this Agreement in the following manner:

19.1.1

To the most recent physical address The Lender holds for the Borrower on file.

By delivery to any email address provided during the application process.

19.1.3

By delivery of an SMS to any mobile telephone number the Borrower has provided to The Lender.

By posting such notice on the Lender’s website.

20.0. Event of Default

20.1

The borrower fails to make a scheduled repayment in full on or before the payment due date according to the repayment plan provided to them.

20.2

Any representation/information, warranty, or assurance made or given by the Borrower in connection with the application for this loan or any information or documentation supplied by the Borrower is later discovered to be materially incorrect; or

20.3

The Borrower does anything that may prejudice the Lender’s rights in terms of this Agreement or cause the Lender to suffer any loss or damage.

20.4

In the event of any default by the Borrower subject to clause 17.0. above –

20.4.1

The Lender may transfer its right, title, and interest under the Agreement to an external Collections Agency, who will take all reasonable steps to collect the outstanding loan amount.

20.4.2

The Lender also reserves the right to institute legal proceedings against the defaulting Borrower and is under no obligation to inform the Borrower before such proceedings commence.

20.4.3

The Borrower shall indemnify and hold harmless the Lender and its representatives (each, an “Indemnified Person”) from and against any and all suits, actions, proceedings, claims, damages, losses, liabilities and expenses (including, without limitation, counsel’s fees and disbursements and other costs of investigation or defence, including those incurred upon any appeal) which may be instituted or asserted against or incurred by any Indemnified Person as the result or arising out of:

credit having been extended, suspended, or terminated under this Agreement or

any loan documents and the administration of such credit and in connection with or arising out of the transactions contemplated under this Agreement or any loan document and any actions or failures to act in connection therewith and any legal costs and expenses arising out of or

incurred in connection with disputes between or among any parties to this Agreement or any loan document (collectively, “Indemnified Liabilities”).

Provided that the Borrower shall not be liable for any indemnification to an Indemnified Person to the extent that any such suit, action, proceeding, claim, damage, loss, liability, or expense results solely from that Indemnified Person’s gross negligence or wilful misconduct, as finally determined by a court of competent jurisdiction.

21.0 Data Protection and Customer Consent

21.1

Please note that our Privacy Policy governs the processing of your data which can be found on our website. By accepting our Terms of Use, you also agree to comply with our Privacy Policy, Anti-Money Laundering Policy, and any other policy displayed on our website. We advise you to print and keep a copy of the Privacy Policy along with these Terms of Use.

21.2

By default, you will receive regular e-mail newsletters informing you about new product features, events, promotions, and other special deals. By accepting our Terms of Use, you agree to receive these newsletters. However, if you do not wish to receive any newsletters, you can opt-out at any time by logging into your SLR account and changing the appropriate setting in your Account. You can also contact our Customer Service to opt-out of receiving newsletters. Each newsletter you receive will also give you the option to unsubscribe from any future newsletters.

21.3

When you register on the SLR app, you will be asked to provide us with some of your personal information such as your name, email, gender, and date of birth. Sometimes, we may need additional information to ensure your account's security or to provide specific services to you.

21.4

If you need to modify any of your personally identifiable information on the SLR app, you can contact Customer Service or change your account profile within the app. Some of your information will be updated instantly, while other details may require further verification before they can be changed.

21.5

When you use SLR from your device, we may collect information such as your browser type, location, and IP address, as well as the pages you visit. We collect this information for security purposes.

21.6

When you use our mobile applications, we may ask for access to your phone contacts. We will only upload your contacts to our servers if you give us explicit permission to do so. We will not share your contacts with any third party.

21.7

We ask for access to the following functionalities while utilizing our mobile applications:

  • a. Camera: allows you to take a profile picture scan, and capture payment card details to make payments easier and faster.
  • b. Photo Library: provides access to your photos as an optional source for your profile picture.
  • c. Fingerprint or Facial Recognition: allows you to log into the application securely. We will only ask for permission the first time the user attempts to use any of these functions. After that, the user may manage access through the settings option on the device.

21.8

After you make a transaction or payment using SLR, we are required by law to keep a record of the details. This information will remain confidential and will only be disclosed to third parties if required by law. We may also share this information with our representatives, professional advisers, or third-party service providers to enhance our services to you. We take your data privacy seriously, and we will ensure that your data is treated securely and in accordance with our Privacy Policy.

You agree that all your information, including personal details, telephone conversations with our Customer Services, and transactions may be recorded and stored for quality assurance and record-keeping purposes. This data will be retained for up to five (5) years from the date on which your Account is closed.

21.10

By selecting "I agree to the Terms and Conditions" on the application form, you adopt them as your electronic signature. By doing so, you understand, consent to, and agree that:

21.11

We can provide you with materials and information about your legal rights and duties electronically. Your electronic signature on agreements and documents is just as valid as a signature using ink on paper or any other physical means.

21.12

We can send all important communications, billing statements, demand notes, and reminders (collectively referred to as "Disclosures") to you electronically via SMS or to an email address that you provide to us when applying for this loan. We will notify you when the Disclosures become available by sending you an electronic communication. Our email will provide you with instructions on how to access the Disclosures. You may view and print a copy of the Disclosure or download the information for your records. This consent applies to this transaction, all future Disclosures on this Account, and all future transactions in which you use the SLR Payment option with us. It also applies to other Disclosures that we provide to you by email, unless you have previously withdrawn your consent by following the procedure mentioned below. By consenting, you agree that electronic Disclosures have the same meaning and effect as paper Disclosures. When we send you an email alerting you that the Disclosures are available electronically and make them available online, that shall have the same meaning and effect as if we provided paper Disclosures to you, whether you choose to view the Disclosures unless you had previously withdrawn your consent to receive Disclosures electronically.

21.13

We take several measures to ensure the security of your Account information. Our servers are equipped with firewalls and encryption to keep your data safe during transmission and storage. Additionally, we employ both automated and social methods to enhance security. This includes analyzing account behavior for signs of fraudulent or anomalous activity, limiting the use of SLR features in response to such activity, and suspending or disabling accounts for violations of our customer terms and conditions.

21.14

Unless stated otherwise, our current privacy policy applies to all information we have about you and your Account. We suggest that you periodically check our App for any changes to our privacy policy.

21.15

Please refer to our Privacy Policy on this App for more details. The policy explains how we collect and use your information.

23.0 Termination and Suspension

23.1

We reserve the right to terminate your SLR account or any associated payment services in the event of a breach of the terms set out in this document, with prior notice of 21 days.

23.2

You may terminate your SLR Account with us at any time, as long as you do not have an active loan with SLR.

23.3

We reserve the right to suspend or terminate your SLR Account if you violate any conditions stated in these Terms of Use or in separate terms and conditions that apply to specific services. If such an event occurs, we will provide you with a notice of 21 days.

23.4

If you violate any law or regulation that applies to your use of our services, or if we have reason to believe that you are involved in any fraudulent activity, money laundering, terrorism financing, or other criminal activity, we may take action accordingly.

23.5

We reserve the right to temporarily deactivate your SLR Account if necessary. This may occur at any time if:

  • We have reason to believe that your SLR Account may have been compromised or used fraudulently without your authorization, or for other security reasons.
  • If we suspect any such activity, we will notify you promptly unless prohibited by law.
  • We reserve the right to terminate this Agreement at any time and for any reason, in accordance with applicable law.
  • In case of termination, we will send written notice to the address provided on your application.
  • If there is no debit or credit activity on your account for twelve consecutive months, we may terminate it without prior notice.
  • If we terminate your account due to default, you will not be eligible to apply for credit in the future.

24.0 Taxes

24.1

• All payments related to these Terms and Conditions, or any Services provided to you by SLR will be calculated without including any taxes payable by you or on the Services. If any taxes are due in connection with the payments, you must make sure to pay such taxes and pay SLR additional amounts to ensure that SLR receives the complete amount it would have received if no taxes were applicable to the payments.

24.2

By using SLR’s services, you agree that we may withhold funds in your account as required by any tax authority or law. We may also withhold funds in compliance with internal policies or any applicable order or sanction of a tax authority. We will notify you if any such deductions are made.

24.3

All payments to be made by you under this Agreement must be made in full, without any set-off or counterclaim. Additionally, you must make payments free and clear of any deductions or withholdings. If you are required by law to make any deduction or withholding from any payment to SLR, you must immediately pay SLR the additional amounts necessary to ensure that SLR receives the full amount it would have received had no such deduction or withholding been required.

25.0 - Communication Between Us

25.1

If you need to get in touch with us or if any of the conditions in these Terms and Conditions require you to give notice to SLR, you can send us an email at support@standardlife.org.rw or to the email address that we may communicate to you from time to time. We will confirm the receipt of your email by contacting you in writing via email.

25.2

If we need to get in touch with you or send you any written notice, we may do so by posting it on our website or the app, sending an email or SMS to the email address or mobile number you provided to us.

26.0 Keeping Your Account Secure

26.1

It is important to keep your security information regarding your SLR account and the SLR app secure. In case you suspect that your account's security may have been compromised, please inform us immediately. Also, change your password and other security credentials as soon as possible. Please note that if there are any transactions carried out through your account because of your account being compromised by you, malware, or human interference outside of our control, SLR will not be held liable.

27.0 General

27.1

A partial exercise of any right, power, or remedy shall not preclude any further or other exercise of that, or any other, right, power, or remedy.

27.2

If SLR fails to exercise or delays exercising any of its rights or remedies under this Agreement, it will not waive those rights or remedies, including its right to enforce repayment of any outstanding amounts on the due date.

27.3

In the event that any term or part of this Agreement is deemed invalid or unenforceable by a court of competent jurisdiction, it shall not affect the validity or enforceability of the remaining terms or parts of this Agreement. All other provisions of this Agreement will remain fully.

27.4

SLR has the right to transfer or assign its rights and obligations under this Agreement, which may include the obligation to lend money, or the amount owed under this Agreement, to another party. We will notify you if such a transfer results in any change that may affect your Services. Please note that you are not allowed to assign this Agreement or any rights or liabilities accruing thereunder to any other person.

28.0 The Entire Agreement

28.1

These Terms and Conditions, along with our Privacy Policy, are the complete agreement between you and us, and replace all previous agreements, promises, assurances, warranties, representations, and understandings between us, whether written or oral, pertaining to the subject matter at hand.

28.2

You acknowledge that by entering into this agreement, you have not relied on any statement, representation, assurance, or warranty that is not explicitly set out in these Terms and Conditions or our Privacy Policy, whether made innocently or negligently.

29.0 User Representation

29.1

(1) All registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary.

30.0 User Representations

31.1

You represent that you meet the eligibility criteria outlined by Standard Life Rwanda plc, including that you are not less than 18 years.

30.2

You represent that all information provided during the loan application process, including personal, financial, and contact details, is accurate, complete, and up to date.

30.3

You agree to comply with all the terms, conditions, and policies established by Standard Life Rwanda regarding the loan application, disbursement, repayment, and any associated fees or charges.

30.4

You authorize SLR to verify the information provided by accessing credit reports, financial records, and other relevant sources to evaluate your eligibility and creditworthiness.

30.5

You are responsible for maintaining the confidentiality of your login credentials and ensuring that no unauthorized access or use of the loan app occurs from your account.

30.6

You consent to receive communications, including notifications, updates, and promotional offers related to loan products, via email, SMS, or app notifications.

30.7

You acknowledge that loans involve financial obligations and understand the terms, interest rates, repayment schedules, and any associated penalties or fees before accepting the loan offer.

30.8

You represent that you have the legal capacity to enter into a loan agreement and that you are not prohibited from obtaining loans under any applicable laws.

30.9

You agree to abide by the terms and conditions outlined by Standard Life Rwanda Plc, including its privacy policy and loan agreement terms.

30.10

You understand and agree that Standard Life Rwanda Plc reserves the right to modify, update, or change the loan app features, terms, or policies at its discretion.

31.0 The Governing Law and Dispute Resolution

31.1

This agreement shall be governed by and construed in accordance with the laws of the Republic of Rwanda.

31.2

Any dispute, controversy, or claim arising out of or relating to this agreement, including its formation, interpretation, performance, breach, or termination, shall be resolved through good faith negotiations between the parties.

31.3

In the event that the parties are unable to resolve the dispute amicably within a reasonable period, they agree to submit the dispute to mediation administered by a mutually agreed-upon mediator or by the Rwanda Mediation Centre.

31.4

Should mediation fail to resolve the dispute, the parties agree that any unresolved dispute shall be finally settled by arbitration in accordance with the Arbitration Law of Rwanda.

31.5

The arbitral award shall be final and binding upon both parties. The parties agree to waive any rights to appeal or challenge the arbitral award to the fullest extent permitted by law.

31.6

Notwithstanding the above provisions, either party reserves the right to seek injunctive or equitable relief or to bring an action in a court of competent jurisdiction to enforce or protect its intellectual property rights or confidential information.

31.7

The costs, including legal fees and expenses, incurred in any mediation, arbitration, or court proceedings pursuant to this clause shall be borne as determined by the arbitral tribunal or court, as applicable.

32.0 Intellectual Property Rights:

32.1

All content, trademarks, logos, designs, information, graphics, and materials published or made available through our site/app are the exclusive property of SLR unless otherwise indicated. These are protected by intellectual property laws, including copyright, trademark, and other applicable laws.

32.2Users are granted a limited, non-exclusive, revocable license to access and use our site/app for personal or non-commercial purposes, strictly in accordance with these Terms and Conditions.

32.3Users agree not to:

  • 32.3.1 Reproduce, distribute, modify, or create derivative works of any content or materials without explicit authorization.
  • 32.3.2 Use any automated means or conduct data mining or extraction of content from our site/app.
  • 32.3.3 Use our trademarks, logos, or other proprietary information without prior written consent.
  • 32.3.4 Circumvent, disable, or interfere with security-related features of the site/app or its features.
